Kisumu City Manager Abala Wanga has ordered voluntary removal of all unauthorized temporary structures, particularly those interfering with sewer lines, drainage systems, and other public utilities, within seven days.
In an enforcement notice issued under Section 72 of the Physical and Land Use Planning Act 2019, Wanga said the city has noted with concern the erection, placement, and use of temporary and/or unauthorized structures within the city without the requisite development permission, approvals, or licenses, which are contrary to the law.
He added that the notice is issued pursuant to Section 72 of the Physical and Land Use Planning Act 2019, Section 4 of the Fair Administrative Action Act 2015, and the Kisumu County Act 2024.
“This Notice applies to all traders, occupants, and persons who have erected or placed structures that interfere with, are built over, obstruct, or compromise sewer lines, drainage systems, stormwater channels, water pipelines, power lines, or any other public infrastructure or utilities, and continued occupation after expiry or without issuance of requisite permits,” read part of the notice.
He sternly warned that failure to comply with the Enforcement Notice constitutes an offense under Section 72(5) of the Physical and Land Use Planning Act, and any person who fails, neglects, or refuses to comply with the Notice after the elapse of the stipulated notice period shall be liable to prosecution and will, in addition, face any enforcement action undertaken by the city.
“Any person aggrieved by this Notice may, within the notice period, make representations in writing to the City Manager or present themselves to the City’s Department of Planning during official working hours,” Abala said in the signed notice.
